| Electoral List available at the OAC in Benissa Municipal and regional elections will be held on May 24. Spanish and European citizens will be able to vote provided they are on the electoral roll. To make sure that you are eligible to vote, please consult the electoral list at the following dates, time and place. TIME: From 6 to 13 April 2015. El próximo miércoles día 17 de diciembre a las 9.30h en el salón de plenos del Ayuntamiento de Benissa, se llevará a cabo una reunión explicativa sobre la campaña de empadronamiento.

1)Many have seen the IBI tax increase this year. Why?
The mayor explained as a
result of the increase of the catastral values due to the review in 2005, 2014 is the last of the 10 year phase in
which the adjustment to the higher rate is seen in the tax bill.
The mayor intends to seek
another review of catastral values in light of the downturn in the property
market. At the earliest, this would affect the IBI from 2016.
The mayor promised due to
lack of infrastructure in the coastal area of Benissa, the IBI on land (not
construction) would be reduced by 20%. This would be reflected in next year´s
tax bill.
2)It appears that some reductions have already taken place, but the situation is still not clear. From what we learned, this reduction would apply6 only in areas where land has been urbanized and overvalued for tax purposes, for example up to 200 euros/sq m. That reduction should be in place next year given that the cadastral office has agreed to this reduction. However, this does not apply to all properties since some are already taxed at a low (less than 20 euros/sq m). These taxes will not be adjusted downwards.
3)The Supreme Court (TSJ)
recently decided that property owners in unfinished urbanisations shouldn´t pay
taxes at the higher ‘urbana’ rates. Instead they should be taxed at the lower
´rustica´ rates. That is finished urbanisations accepted as such by the town
hall, should be the only ones where the úrbana´ rates are charged. There are
very few finished urbanisation in Benissa.
The reduction should already
be in effect, but will likely only be in place in 2015.
The mayor has to pick this up
by the catastral office again. This should result in a substantial decrease of
the IBI in the rural areas of Benissa.
We will follow this closely.
4)Benissa´s town plan (PGOU)
from 2003 was annulled by the Supreme Court last year. This means that none of
the urbanisations subsequently approved have a legal basis. There is a trusted
lawyer on standby to take these cases forward. If you wish to proceed, please
let Lisa or Hubert know asap.
Additionally, as a result of
another case that AUN took forward, it is clear that the earlier 1982 PGOU is
also not valid. This means that almost all the rural areas of Benissa should be
classified as ´rustica´. That is also pursued in a letter to be written to the
mayor this week.
5)VdeB suggested that
members in rural areas of Benissa obtain a certificate indicating the
classification of their property. This certificate is useful to have in any
event, given the outcome of the court case. This may not be immediately
relevant to IBI taxes as was thought earlier. So, it remains an o9pen option to
seek suchy a document, but the response should be based on the total absence of
any planning document for Benissa. That is, there is no valid PGOU in Benissa.
We are told that the
Generalitat in Valencia is preparing a transitory PGOU which will be valid for
two years. This will allow enough time to draft a new town plan. We understand
that during this two year period, all rural property (unfinished urbanisation
and rural land) will be taxed as ´rustica´, the lower rate.
At the same time, we read in
the press that the national government was considering raising the IBI tax.

- Viele haben die Erhöhung der IBI-Steuer in diesem Jahr gesehen. Warum?
Der Bürgermeister hat dies als Folge der Katastererhöhung in 2005 erklärt. In 2014 wurde die letzte 10%-Rate dieser Erhöhung fällig.
Der
Bürgermeister beabsichtigt eine weitere Revision der Katasterwerte
zu versuchen, wegen des Rückgangs des Immobilienmarktes. Dies würde
frühestens die IBI von 2016 betreffen.
Der
Bürgermeiste hatte wegen der fehlenden Infrastruktur in der
Küstenzone von Benissa versprochen die IBI auf Gebäude um 20% zu
senken. Dies würde in der Rechnung des nächsten Jahres zum Tragen
kommen.
- Es scheint, dass einige Senkungen bereits erfolgt sind, aber die Lage ist immer
noch
nicht klar. Nach dem was wir erfahren haben würde diese Reduzierung
nur Bereiche betreffen, wo das Land urbanisiert und für die
Besteuerung überbewertet worden ist, z.B. 200 Euros/qm. Diese
Reduzierung sollte im nächsten Jahr angewendet werden voraus
gesetzt, dass das Katasteramt dieser Reduzierung zustimmt. Dies
trifft jedoch nicht auf alle Grundstücke zu, da viele bereits mit
einer geringeren Steuer (<20 Euros/qm) belastet sind. Diese
Steuern werden nicht nach unten korrigiert werden.
- Der Oberste Gerichtshof hat kürzlich entschieden, dass Grundstückseigentümer
von
unfertigen Urbanisationen nicht die höheren Steuern von
Urbanisationen bezahlen sollten. Statt dessen sollten sie nach den
niedrigeren Rustica-Raten besteuert werden. D.h. abgeschlossene und
als solche vom Stadtrat abgenommene Urbanisationen, sollten die
einzigen sein wo „Urbana“-Raten angewendet werden. Es gibt sehr
wenige abgeschlossene Urbanisationen in Benissa. Die Reduzierung
sollte bereits eingeführt sein, wird aber wahrscheinlich erst in
2015 in Kraft sein.
Der
Bürgermeister muss dies beim Katasteramt wieder angehen (Brief von
Bernardino, Stadtarchitekt?). Dies sollte zu einer wesentlichen
Reduzierung der IBI in den ländlichen Bereichen Benissas führen.
Wir werden dies aufmerksam verfolgen.
- Benissas Flächennutzungsplan (PGOU) von 2003 ist im letzten Jahr vom Obersten
Gerichtshof
annulliert worden. Dies bedeutet, dass keine der danach genehmigten
Urbanisationen eine legale Basis hat. Ein zuverlässiger Anwalt steht
zur Verfügung um diese Fälle aufzunehmen. Wenn Sie entsprechend
vorgehen wollen wenden Sie sich bitte so bald wie möglich an Lisa
oder Hubert.
Ausserdem
ist als Ergebnis eines anderen Falles den AUN zur Anzeige gebracht
hat klar, dass der frühere PGOU von 1982 ebenfalls nicht gültig
ist. Dies bedeutet, dass nahezu alle ländliche Bereiche Benissas als
„rustica“ klassifiziert sein sollten. Das wird auch in einem
Brief der diese Woche an den Bürgermeister geschrieben wird
dargelegt.
- VdeB hat vorgeschlagen, dass Mitglieder in ländlichen Bereichen Benissas ein
Zertifikat
erhalten, dass die Klassifizierung ihres Eigentums feststellt. Es ist
wichtig, dieses Zertifikat für alle Fälle zu haben, für eine
Gerichtsfall. Dies muss nicht sofort relevant für die IBI-Steuer
sein, wie anfänglich gedacht. Es ist also eine freie Option, solch
ein Dokument anzustreben, aber die Antwort sollte auf das völlige
Fehlen jegliches Planungsdokumentes für Benissa basieren. D.h. es
gibt keinen gültigen PGOU in Benissa!
Uns
wurde erläutert, dass die Generalitat in Valencia einen
Übergangs-PGOU vorbereitet der für zwei Jahre gelten wird. Dies
wird genügend Zeit erlauben um einen neuen Flächennutzungsplan zu
entwerfen. Wir verstehen darunter, dass während dieser zwei Jahre
jeder ländliche besitz (nicht abgeschlossene Urbanisation und
ländliches Gebiet) als „rustica“ besteuert wird, mit der
niedrigeren Rate.
Zur
gleichen Zeit lesen wir in der Presse, dass die National-Regierung
überlegt, die IBI-Steuer anzuheben?

Our next special meeting on the IBI (property tax) will take place on Thursday, October 16 between 4 and 6 p.m. in the Asia Restaurant on the Calpe to Moraira Road. English speaking property owners are invited for the session between 5 and 6 p.m., while those speaking German are invited for 4 p.m.
The meeting will deal mostly with the IBI (property tax) issue, as affected by the Mayor's commitment to have the property taxes reduced in the coastal zone and by the recent Supreme Court decision on the classification of undeveloped land.

Diese Versammlung wird sich an meistens mit der IBI (Grundsteuer) beschäftigen in Bezug auf die Zusage des Bürgermeisters, die Grundsteuer in Küstengebiet zu reduzieren, und der kürzlichen Entscheidung des Obersten Gerichtshofes zu der Klassifizierung von nicht entwickeltem Land.
