Members Meeting, November 17, 2011

The first meeting following the AGM on October 20 was called to order at 17:00h.

Future Programs:


Priorities:
  1. Simplifying and streamlining procedures
  2. Increase membership, e.g. activating former members and recruiting new ones trying to get more members from Benissa town and countryside.
  3. Rebalance the different nationalities, more Spanish and English speaking members.
  4. Coordination with other Associations (e.g. Montemar, St. Jaime…)
  5. Streamlining the meetings considering that they are held in 3 languages. More informal meetings for interaction between the members without agenda but maintaining the possibilities to ask questions.
Plans:


  1. Plans for meetings with local bodies (mayor, city deputies etc.) after the upcoming elections.
  2. Offer “Clinics” (special consultations) for members 2 times a month (Monday 11-12 a.m.) to take off the pressure from formal meetings and giving members a chance to ask personal questions outside the General Assembly.
  3. Next appointments: 5th and 13th?? (this needs to be checked with Julia and Margit, as this is a Tuesday, not a Monday) of December in the Aula de Mar.
  4. Julia Martinez continues to offer Spanish conversation courses on Wednesdays from 10 to 12 a.m.
The Blog:
  1. Lisa Svoboda developed a blog www.vdeb.blogspot.com, which is easier to handle than the website. The blog has different sections like homepage, minutes, membership, calendar, contacts….
  2. There should be a link between the old website and the blog, a point that depends on the collaboration of the past president who still holds all the information.
  3. There is a new cell phone # 634 304 604 to facilitate the communication between the members and the board, whose members will take turns attending the phone.
Other Issues:


Picudo Rojo:


Hubert Vockensperger presents useful information related to the “picudo rojo”, emphasizing that there is no longtime experience and that there is a need of collaboration of everybody. See paper in the attachment.
There are many affected palms, mostly in abandoned plots, but the official reaction seems not to be sufficient to attack the plague and although there is a law, it is not enforced. Therefore AVB proposes to take pressure on the town hall and offer collaboration in baseline studies and organization.

Road repair and asphalting:


Julia Martinez denounces the bad conditions of the roads in our community and remembers the mayor’s promise to fix them.
Although the major has identified the roads to be repaired, AVB will ask the Mayor to consider priorities and also ask the members for their input.

Rastro:


There is a new flea market in the green/recreation zone of Fanadix on Saturdays. Although the market is authorized there seems to be no supervision.
The identification numbers for the stands are nailed to the trees, provoking their future disappearance.
There is a “chiringuito” and all the trash related to it is not retrieved afterwards, damaging the recreational character of the area.
There is a main road going trough the area what can cause accidents for persons and cars.
The neighbors are protesting because of the security in the surrounding area.

Caritas:


Paloma Hoffman presents a resume of the situation in relation to the Caritas Project.
The donations (Euro 1.650 from January to November 2011) has been used to buy food which was given once a month to the Caritas Organization, actually leaving nothing but 100 Euro in the box.
The box passed between the present members collecting new donations in order to continue with the help activities for Caritas.

Bericht des Praesidenten 2010 / 2011
 
Dieser Bericht enthält die wichtigen Tätigkeiten unserer Vereinigung im Zeitraum Oktober 2010 bis September 2011.
  1. Oktober 2010
  1. Am 5. Okt. wurde durch den Bürgermeister eine genaue Erläuterung zu der Impuestos Bienes Inmeubles, IBI, gegeben. Er erwähnte u.a. die Ponencia del Valores und sicherte Unterstützung bei der Bestimmung der korrekten Klassifizierung zu.
  2. Am 21. Okt. hatten wir unsere Hauptversammlung.
  1. November 2010
  1. Fragestunde mit dem Bürgermeister am 24. (De) und am 25. (En) Nov. 
  1. Die englische Sitzung wurde durch die Nichtverfügbarkeit des Bürgermeisters verhindert. Die Sitzungen wurden daher vorverlegt auf den 23. und 24. Nov.
  2. Während der deutschen Sitzung kam eine hitzige Debatte in Bezug auf die PGOU auf, der Wunsch nach mehr Flexibilität der PGOU und schließlich die Kostenbeteiligung an der Entwicklung der Urbanisation Pedramala-II. Eine Aussage wurde gemacht, dass Herr GK seinen Anteil nicht zu zahlen hätte, wenn er weitere Bautätigkeit auf seinem Grundstück einstellen würde.
  3. Wichtige Punkte waren die Arbeitslosigkeit, die Zuteilung der Finanzierungen von Madrid, der Palmrüssler, die IBI und den Reklassifizierungsprozess (urbano / urbanizable und rustico) bestimmter Parzellen.
  1. IMPULS gab in Zusammenarbeit mit der Universität Alicante Informationen über den Palmrüssler und bat um Unterstützung bei der Einrichtung eines Warnsystems. Paloma Hoffmann hat diese Unterstützung gegeben.
  1. Dezember 2010
  1. PEDRAMALA-II Der Bürgermeister setzte eine Besprechung mit GK an um über die heißen Themen während der Fragestunde im November zu reden. GK wiederholte seine Aussage, dass er das Angebot nur dann annehmen könnte, wenn die anderen Nachbarn in gleicher Weise behandelt würden. Dazu übergab er einige Fotos von faktischen Belegen von Bauvorbereitungen, wo hingegen es laut Informationen des Bürgermeisters mindestens zehn Jahre dauern würde, um mit Pedramala-II zu beginnen.
  2. Arbeitslosigkeit. Wir nahmen die Gelegenheit wahr nachdrücklich darauf hinzu weisen, dass der Bauboom vorüber war und das Rathaus andere Industrien unterstützen sollte um Arbeitsplätze zu schaffen. Es sollte Essen auf dem Tisch kommen, oder?
  3. Picudo Rojo. Ein von IMPULS und örtliche Gärtnereien unterstützter Vortrag wie der Picudo Rojo zu bekämpfen ist, wurde gehalten. In Kürze: Es gibt zwei Möglichkeiten, chemisch und biologisch. Der biologische Weg ist, eine bestimmte Pilzart in die Palme einzubringen. Der Picudo Rojo wird durch diese Pilzart befallen und ist nicht nur nicht mehr lebensfähig, sondern verschleppt diesen Pilz auch in andere Palmen und infiziert weitere Käfer.
  4. Padron. Das Angebot, zu dem Rathaus transportiert zu werden, um sich in den Padron registrieren zu lassen und an den Wahlen teil zu nehmen, einschl. eines gratis Kaffee, wurde wiederholt. Es kamen keine Reaktionen!
  5. CARRIONS. Betroffene Personen erhielten Unterstützung um eine Vollmacht für den Staatsanwalt von einem örtlichen Notariat zu erhalten. Einer Familie wurde dies versagt, wegen Fehlens des Eigentümernachweises. Der eigentliche Eigentümer hatte ernste Gesundheitsprobleme.
  1. JANUAR 2011
Zertifizierung der Bodenklassifikation durch Benissa. Viele Anfragen, manche zum Vorteil des Rathauses andere zum Vorteil der Eigentümer wurden bearbeitet und in manchen Fällen Daten geändert. Gute Zusammenarbeit mit dem OAC, manchmal Probleme mit dem Büro für Urbanisation.
 
5. FEBRUAR 2011
  1. Politische Programme. Die Absicht war, von allen Parteien Informationen zu der bevorstehenden Wahl zu erhalten. Ein Zeitplan für die Parteien wurde erstellt. Zusätzlich sollte Herr Estupina uns die letzten Informationen aus dem Rathaus geben. Er war jedoch verhindert und als Ersatz sprang der Bürgermeister ein.
  2. Einige Fragen zu La LLobella mussten beantwortet werden. Der aktuelle Status des PAI’s ist sehr wichtig, weil ein PAI den Verkaufswert Ihres Grundstücks herab setzt. Es schien, dass einige Makler schlecht informiert waren. Der Bürgermeister sprach von 2 genehmigte PAI’s. Tatsächlich sind 9 oder 10 PAI’s genehmigt und insgesamt sind damit 6300! Häuser geplant.
  3. Der Ersatzmann für dieses Treffen, der Bürgermeister, nahm die Initiative um die letzten Informationen zur IBI von Madrid zu erhalten, kehrte von Madrid mit dem AVE zu spät zur Versammlung zurück, aber mit der wichtigen Information, dass Madrid gewillt wäre den 10 Jahres Zeitraum (Base liquidable 2005 – 2014) um den Wert der „Revaloracion Catastral von 2004“ zu erreichen, bis 15 Jahre zu verlängern. Unser Ziel ist es jedoch, den zu hoch geschätzten Wert der Revaloracion Catastral von 2004 zu korrigieren, da die V.C. die Basis für andere Steuern ist. Es besteht offenbar eine Neigung des Finanzamtes die IBI zu überprüfen.
  4. Die Anwesenheit des Bürgermeisters bei diesem Treffen war nicht vorhergesehen und peinlich, weil die PSOE vorgesehen war Informationen über ihr Wahlprogramm zu geben. Ein Grund den Bürgermeister hinaus zu bitten, sobald einige vorbereitete Fragen gestellt wurden. JBRT’s Reise nach Madrid war jedoch willkommen, wir hätten die Sache mit der Revaloracion aber anders angehen sollen.
  5. Beim Hinaus gehen fragte ich den Bürgermeister mir den Verlauf der C. Morera zu erklären und bat ihn auf seinem Rückweg dort vorbei zu schauen.
  6. Das Wasseramt CHJ schließlich machte eine schriftliche Aussage bekannt, dass als Vorbedingung für jeden PAI eine eigene Genehmigung des CJH erforderlich ist. Ohne das ist ein PAI illegal!
  7. Eine Präsentation des PSOE Programms fand statt.
  8. Der Start der „Offenen Bürostunden“ jeweils donnerstags von 10:00 bis 11:00 Uhr. Es braucht Anlaufzeit. Obwohl wenige Personen teilnahmen ist es in zweierlei Hinsicht wichtig so fortzufahren: Verfügbarkeit und den Gebrauch der Aula del Mar durch uns, und den internen Kontakt mit D.C. und J.
  1. Kurs „Der kleine Lebensretter“. Der von Dr. Stötzer, Jutta Horwart und IMED durchgeführte Kurs war ein Erfolg. Neben den vielen Übungsstunden wurden die Leute mit IMED bekannt gemacht, der medizinische Einrichtung in Teulada. IMED unterstützte den Kurs mit diversem Übungsmaterial. Jutta lenkte unsere Aufmerksamkeit auf den handlichen Führer „Wie sag ich es meinem Doktor“ und die Existenz von Masken um der Furcht vor Mund zu Mund Beatmung zu begegnen. Sie schaffte es einen Defibrillator für die Küste zu beschaffen: Dr. Stötzer beschaffte ein solches Gerät um Sie in einer Notsituation helfen zu können. Möglicherweise ist die Polizeiwache in La Fustera ebenfalls mit einem Defibrillator ausgerüstet.
  1. MÄRZ 2011
  1. Information politische Programme. Der für die Parteien vorgesehene Zeitplan wurde nicht eingehalten und wir hatten keine Informationen im Anschluss an unserer Versammlung.
  2. Carrions. Der Urbanisator Breviator hat den Betroffenen Briefe gesandt um sie über die beträchtlichen Kosten die zu bezahlen sind (40 bis 300.000 Euros/ Person) zu informieren, und dass weitere und genauere Informationen zu der Reparzellierung im Rathaus zu finden wären. Frau A. der Urbanisierungs Abteilung gab mir eine Kopie der meist interessanten Teile des Dokuments. Wir gingen die Unterlagen durch und konnten so die Betroffenen und ihren Anwalt J.B.L. in Kenntnis setzen. AUN hat einen Beitrag zu den Anwaltskosten geleistet.
  3. Falsche Gasinspektoren. Warnung vor falsche Gasinspektoren. Daumenregel: Hast Du die Inspektoren angefragt? Wenn nicht rufe die Polizei an und mach ein Foto der „Inspektoren“ und wenn möglich von dem Autokennzeichen.
  1. APRIL 2011
  1. Politische Präsentation CIBE. Eine Präsentation war vorgesehen, konnte aber nicht statt finden.
  2. Aula del Mar. Ein Versuch diese Räumlichkeit für unsere Versammlungen zu nutzen, da Audio- und Video-Anlage vorhanden, jedoch die Luft ist schlecht und es können keine Getränke konsumiert werden.
  3. CARRIONS. Zusätzlich zu den Briefen ist das Reparzellierung-Vorhaben durch den Urbanisator in dem „Diario Official“ (DOVC) veröffentlicht worden. Ein Treffen zwischen Anwalt und Bürgermeister fand statt und Schreiben des Anwaltes in Bezug auf die Unstimmigkeiten im Carrions Prozess wurden übergeben. gab dies zu und annullierte die DOCV Veröffentlichung vom 6. April durch Breviator und beauftragte das Rathaus die Unterlagen des Urbanisators zu überarbeiten. Auf Anfrage gab AUN finanzielle Unterstützung.
  1. MAI 2011
  1. Informationen über politische Programme. Um allen politischen Parteien Gelegenheit für ihre Präsentation zu geben wurde eine Sitzung am 12. Mai mit PSOE, CIBE und BLOC geplant. Erst der älteste, dann der jüngste und dann CIBE. Aus Respekt für die Opfer des Erdbebens in Llorca waren zwei Parteien nicht anwesend. Das wurde so akzeptiert, aber die Sitzung wurde dennoch wie geplant durchgeführt.
  2. Verlängerung von PAIs. Die Communidad Valencia hat die PAIs La Llobella I, II und Magraner verlängert.
  3. Wahlen am 22. Mai. Transportmöglichkeiten wurden angeboten, aber nicht genutzt.
  4. IMED Teulada. Jutta organisierte einen Besuch in der Poliklinik IMED um über Versicherung und Gesundheitsdienst informiert zu werden.
  1. JUNI 2011
  1. IBI. Briefe bzgl. IBI wurden dem „Defensor del Pueblo“ (Ombudsmann) geschickt und dieser antwortete mit der Bitte um Klärung zur Straßenbeleuchtung privater oder öffentlicher Straßen und zum Stand der Abwasserbeseitigung, um den Grad der Urbanisation zu ermitteln. Diese Briefe wurde beantwortet und wo möglich fügten wir jeweils den Anstieg der IBI der letzten 7 Jahre bei, um die unverhältnismäßige Erhöhung des V.C. in 2005 aufzuzeigen und, dass wir bereits jetzt über diesen Betrag hinaus gekommen sind. Wir betonten die Grundforderung, dass der V.C. nur 50 % des aktuellen Marktwertes betragen sollte.
  2. Konversation Stunde in Castellano. Unsere VP hat angeboten Konversation Unterrichtsstunden abzuhalten, beginnend am 20. September jetzt Mittwoch vormittags um 10:00 Uhr.
  1. JULI und AUGUST 2011: Sommerpause
Der Ombudsmann hat mit einem zweiten Schreiben reagiert. Die Beweispflicht für den angemessenen V.C. läge bei den Betroffenen.
  1. SEPTEMBER 2011
  1. Impuesto de Patrimonio. Diese Reichensteuer wurde wieder eingeführt ab einem Immobilienwert von 1.000.000 Euro (700.000 Euro für Gewerbliche).
  2. Gratis Kurs Castellano. Das Rathaus bot einen Gratis Kurs an, 4 Wochen bis Ende November. Danach wird EPA (Erwachsenenbildung)einen Kurs für Castellano anbieten.
  3. Unstimmigkeiten bei Baugenehmigungen. Wir unterstützen ein Vorhaben das Unstimmigkeiten bei der Frage, wie viel man auf Agrarland bauen darf, klären soll.

PRESIDENT'S REPORT
 







This report contains the important activities of our association in the timeframe from October 2010 till September 2011.
  1. OCTOBER 2010
    1. On the 5th of October a detailed briefing was given about the Impuestos Bienes Inmuebles , IBI, by the Mayor. He addressed among others the Ponencia del Valores and assured support in the process to get the correct classification.
    2. On the 21th of October we had our General Meeting.
  • NOVEMBER 2010
    1. Question hour with the Mayor at 24 (GE) and 25 (EN) Nov, rescheduled to the 23rd and 24th:
      1. The EN session was hampered by a change of availability of the Mayor.
      2. During the GE session a hot debate arose along the PGOU, the wish to be more flexible with the PGOU and at the end the participation in costs of the development of the urbanization Pedramala-II. The statement was made that Sr GK didn´t had to pay his part, if he would stop further constructions on his terrain.
      3. Important issues were the unemployment, the allocation of the funds of Madrid, the padron, the Picudo Rojo, the IBI and the reclassification process (urbano/ urbanizable and rustico) of certain parcels of land.
  • IMPULS in cooperation with the University of Alicante provided information to neighborhood associations on the Picudo Rojo and requested assistance by the installment of a presence warning system. Paloma Hoffmann was giving her support to this.
  • DECEMBER 2010
    1. PEDRAMALA-II The Mayor scheduled a meeting with GK to talk over the hot issues during his question hour in November. GK repeated his statement, that he only could accept the offer, if the other neighbors were treated in the same way. In addition he handed over some photos of factual facts of preparations of construction, were the information of the Mayor had been that it would last at least ten years to start with Pedramala –II.
    2. Unemployment. We took that opportunity also to emphasize the issue that the boom of the construction era was over and that the town hall should facilitate other industries in order to create jobs. There has to be food on the table, isn’t it !
    3. Picudo Rojo A presentation supported by IMPULS and local gardeners was given on how to fight against the Picudo Rojo. In short there are two options: chemical and biological. The biological approach is based on planting a special kind of toad stools around the palms. The picudo rojo is not able to live in the same area as those toad stools
    4. Padron. The offer of transport to the town hall and a free coffee to get the padron and to participate in the elections was repeated. We didn’t receive reactions.
    5. CARRIONS. Support was given to affected people to acquire an authorization of power for the procurer at the local notary. One family failed due to a lack of proof of ownership, the real owner had severe ability problems.
  • JANUARY 2011
    • Certificates of the classification of the ground issue by BENISSA. A lot of requests were processed, in some cases the data were correct, in some in favor of the town hall and in some in favor of the owner. Good cooperation of the OAC, sometimes trouble at the urban office.
     
        5. FEBRUARY 2011
    1. Political Programs.The approach was to have information of all with regard to the upcoming elections. A time schedule was made to have the parties in. In addition Sr Estipuna would update us this month on the latest news of the town hall. However he was not available. His stand in was going to be the Mayor.
    2. Some questions had to be answered on the issue of la Llobella. The actual status of PAIs is very important, because a PAI is reducing the value of your property in case you are willing to sell. It appeared, that some house brokers were badly informed.
    3. The stand-in for the meeting, the Mayor, took the initiative to get the latest information on the issue of the IBI, returned too late with the AVE from Madrid to the meeting, nevertheless with the vital information, that Madrid was willing to extend the 10 year timeframe (Base Liquidable 2005 – 2014) up to 15 years to meet the value of the “Revaloracion Catastral of 2004”. Our goal however is to correct the too high estimated value of the revaloracion of 2004, since the V.C. is the base for other taxes.
    4. The Mayor´s presence during that meeting was not foreseen and was disputable because PSOE was asked to give information on their program. Reason to get the Mayor out as soon as some pre-orchastred questions were posed.
      JBRT travel to Madrid was however welcome, we had to address the issue of the revaloracion on a different way.
    5. On his way out I asked the Mayor to explain me the stretch / route of the C/ la MORERA and if he could have a look to this road on his way back.
    6. CHJ finally responded with a written statement that every PAI needs to have his own letter of authorization.
    7. A presentation on the PSOE political program was given.
    8. The start of “open office- hours” on Thursdays from 10:00 -11:00h. It needs time to get used to it, although few persons did attend, it is of value to continue in this way, twofold: accessibility and the use of Aula del Mar by us and the inherent contacts with D.C. and J.
    6.  COURSE “THE LITTLE RESCUER”. The course given by Dr Stötzer, Jutta Horwart and IMED was a hit.    Besides the many hours of training, people were made aware of IMED, the medical installation in Teulada. IMED supported the course with several training devices. Jutta made us aware on the handy guides “How to tell it to my doctor” and the existence of masks to lower the fear of mouth to mouth resuscitation. She managed it, to get a defibrillator at the coast: Dr Stötzer purchased such device in order to be able to assist you in case of emergency. If correct the police post at La Fustera is also equipped with a defibrillator.

    7. MARCH 2011
    1. Information political programs: The preplanned briefings the parties was not met and we had no briefer after our monthly meeting.
    2. Carrions: The urbanisator Breviator has sent letters to the affected owners, informing them about the considerable costs to pay (some 300.000€) and that more detailed information of the re-parcellation could be found at the town hall.
      Mrs Amparo of the urban department provided me a copy of the most important parts of the documentation, we scanned this little booklet and could inform in this way all affected people and their lawyer J.B.L..
    3. Fake gas inspectors: Warning for fake gas inspectors. Rule of thumb: Did you ask for the inspectors, if not: Phone the police and take a picture of the “inspectors” and if possible of the license plate of their car. 
    8.  APRIL 2011
    1. Polical presentation CIBE. A presentation was planned but couldn´t take place.
    2. Aula del Mar: Trial to use this facility for our meetings since audio and video equipment is available, however the stench is not acceptable, acoustics is very bad and there are no drinks available.
    3. CARRIONS: In addition to the letters the re-parcellation project is announced in the Diario Offical (DOCV) by the urbanisator. A meeting between lawyer and the Mayor is scheduled and letters of the lawyer are handed over, dealing with the inconsistencies in the processing of Carrions. The mayor admitted and annulled the 6th of April DOCV publication of BREVIATOR and tasked the town hall to redo the paperwork of the urbanisator. On request AUN provided financial support.
    9.  MAY 2011

    1. Information on political programs. In order to enable all political parties to give their presentations a session was planned on the 12th of May with the PSD, BLOC and CIBE. First the senior, then the youngest and then CIBE. Due to respect to the victims of the earthquake in Llorca two parties were absent.
      Point taken, but a ship in heavy weather needs his captain, so we held the meeting as planned.
    2. Prolongation of PAIs. The Comunidad Valencia has extended the PAIs ( La Llobella I, II, Magraner)
    3. Elections 22 May. Transport has been offered, but not been used.
    4. IMED Teulada. Jutta organized a visit at the polyclinic of IMED in order to get information regarding insurances and health services.
     
    10. JUNE 2011

    1. IBI: Letters regarding the IBI were sent to “El Defensor del Pueblo” and the “Defensor” responded with a letter for clarification, asking or the issue of street lightning was related to private or public streets and in addition he wanted more information, such as the status of the sewerage system in order to check the degree of urbanisation.
      These letters have been answered and where possible, we did add an overview of the increase of IBI over the last 7 years to show the disproportional increase of the Valor Catastral in 2005 and to show that we are already over this amount. We stressed the starting point, that the Valor Catastral should only represent 50% of the actual market value.
    2. Conversation lessons in castellano. Our VP offered to give conversation hours starting from 20 Sep. Now on Wednesday mornings at 10:00h.
    11. JULY AND AUGUST 2011: Summer holidays.

    12. SEPTEMBER 2011:
    1. Impuesto de patrimonio. This wealth tax has been reintroduced starting at a value of 700.000 Euros of property value.
    2. Free castellano course: The town hall, sponsored by the Deputación de Alicante, offered a free course, 4 hours per week till the end of November. Thereafter the EPA will offer a course in castellano.
    3. Inconsistencies in licences: We support an issue to clarify inconsistencies in the issue of how much you are allowed to construct on agricultural land.
